‘Probate’ refers to the proving of a Will. Issue of a Grant of Probate confirms the validity of the Will and enables the executors to call in the assets in the estate and deal with the distribution in accordance with the terms of the Will. If the deceased did not leave a Will, or if named executors have passed away, then it is not a Grant of Probate but other terminology is used but the overall umbrella name is a ‘Grant of Representation’. You may hear terms such as a Grant of Letters of Administration and ‘with Will annexed’. One common misconception is that if a Will has been left, then it is unnecessary to go through probate.
Typically a family member or close friend, this is someone who has been named in the Will as having the responsibility of distributing the estate. The Grant of Probate allows ownership of the assets to be transferred to them so that they can gather the deceased’s assets together and pay off any debts and inheritance tax. What is then left of the estate can be distributed according to the deceased’s wishes.
From the value of the estate to joint ownership and disputes, the length of time that probate can take will vary depending on a number of factors. It may be a simple process that takes a few months to complete, or it could be a very complicated one that takes years.
